The State Department is correct. The judicial branch has nothing to say about who gets a visa and who does not. The amount of visas by region and according to 8USC 1153 the Secretary of Homeland Security may suspend or terminate the designation of any regional center. It should also be noted that all of the 675k visas allotted do not have to be filled and can be added to the next years quota. These visas include work visas and skilled workers, professionals, and other workers of which have specific educational requirements including college degrees up to and including Doctoral degrees. Congress (the legislative branch) says how many, what regions (not countries) they are from, and the requirements for those visas. The Executive Branch carries out the programs. Nowhere in the law is the judicial branch even mentioned.

So...when will Vargas be imprisoned for interfering with Federal Immigration Law? Is she willing to personally sponsor all illegals that enter from those countries? Speech is cheap, illegals aren't!
